The MyMedicalHistoryOnline.com service provided on MyMedicalHistoryOnline.com is operated by MyMedicalHistoryOnline, LLC.

1)      Ordering

a)    Access to and use of MyMedicalHistoryOnline.com is subject to this Terms of Agreement, our Privacy Policy, and any other policies displayed on MyMedicalHistoryOnline.com, which together constitute our agreement. To utilize our service, please read and accept both our Privacy Policy and these Terms of Agreement.

b)    It is your responsibility to ensure that you understand and agree to our Privacy Policy and these terms before you submit your order.

c)    When you order records you provide us with certain personal information including name, address, date of birth, city, state, zip code and e-mail address ("Client Information"). The e-mail address will be used as the registered e-mail address for communication. For security purposes you will also need to enter a password and a security question and answer for us to be able to verify your identity.

d)   To create an Account you must be at least 18 years old.

e)   When you place an order, we will use your password, which you create, to encrypt your records.

2)      What We Provide

a)   Subject to our disclaimers below, we will:

i)     provide the means to obtain and forward to you your health information.

ii)    ensure that all Client Information in or relating to your request is treated in accordance with our Privacy Policy.

3)      Our Responsibilities

a)   Subject to our disclaimers below and the terms of our agreement we will:

i)     take reasonable steps to ensure that your records are not subject to unauthorized access or use.

ii)    take reasonable steps to secure MyMedicalHistoryOnline.com and the systems in our control that are used to access MyMedicalHistoryOnline.com, and take reasonable steps to have MyMedicalHistoryOnline.com servers hosted in a secure environment.

b)   We do not, and will not have any responsibility for:

i)     the content of your records, including but not limited to its truth, accuracy, completeness, safety, timeliness, quality, appropriateness, legality or applicability, nor to control, monitor or screen such content prior to it being sent to you.

ii)    accessing any records you obtain through MyMedicalHistoryOnline.com except in accordance with our agreement.

iii)   providing any advice in relation to your records.

iv)   controlling or monitoring the accuracy, completeness, safety, timeliness, quality, appropriateness, legality or applicability of your records or any of your communications.

4)  Our Disclaimers

a)    You acknowledge and agree to each of the following:

i)     The Internet is sometimes unreliable and is a difficult medium to secure. MyMedicalHistoryOnline.com does not guarantee the security of MyMedicalHistoryOnline.com or the systems (including the internet and your hardware and software) used to access MyMedicalHistoryOnline.com, or any information that passes through such systems.

ii)     Given the nature of telecommunication systems, particularly the internet, MyMedicalHistoryOnline.com may not always be available and may not always be fault or defect free.

iii)    We will not monitor the content of your records or documents.

iv)   You are responsible for considering whether MyMedicalHistoryOnline.com is appropriate for you, your requirements and/or your needs. MyMedicalHistoryOnline.com is not intended to be, and should not be relied upon, as a product which substitutes for you seeking appropriate and ongoing medical and healthcare advice, treatment and monitoring.

5)  Warranties and Liability

a)    Our liability to you.

i)     To the extent permitted by applicable law, we exclude conditions that may otherwise be implied into our agreement other than those which cannot be excluded or limited under applicable legislation.

ii)    Except as provided in our agreement, we provide no warranties and have no liability in connection with:

(1)  the law of any jurisdiction other than the State of Illinois;

(2)  any loss or unauthorized access or use of your records;

b)      Limitation of Liability.

i)      If any law implies any condition or warranty that cannot be excluded, then to the extent permitted by law, our liability for any breach of such a condition or warranty is limited to, at our option the remedies set out by that law.

ii)     We are not responsible for and have no liability in relation to:

(1)   personal injury or illness;

(2)   death;

6)  General Matters

a)    Entire Agreement. Our agreement constitutes the entire agreement between you and us regarding MyMedicalHistoryOnline.com, including your records and your access to and use of MyMedicalHistoryOnline.com.

b)    Governing Law. This agreement is governed by the law in force in the State of Illinois, and the parties irrevocably submit to the exclusive jurisdiction of the the State of Illinois in relation to the relationship between you and MyMedicalHistoryOnline.com, and any dispute relating to our agreement. However, you agree that any dispute will be submitted to the American Arbitration Association to be resolved pursuant to their rules and procedures, rather than to any Court.

c)    Severability. If any of the terms in our agreement are invalid, these will be struck out and the remaining terms will remain in force.

d)    Headings. Headings have been written as a guide only and are not to be construed as any construction or limitation.

e)    No Waiver. If we do not act in relation to a breach of our agreement or in respect of any other act, this does not waive our right to act with respect to that, subsequent or similar actions.

f)     No Assignment. You may not assign or transfer your rights or benefits under our agreement to any other person or entity without our prior consent

7) Advertising

a) MyMedicalHistoryOnline.com does not currently display advertising; however, we may at some future time host or receive funding from advertising.

b) All promotional or paid advertising will be listed as "advertisement". All articles, banner or logo advertisements will be clearly indicated.

c) Links to other web sites are offered as a courtesy source for medical information. Many of these sites are close to our hearts and some we think are just useful.
